    1. Vendor identification

    These General Terms and Conditions of Sale are those of ABDOU WORLD S.A.S., a Simplified Joint Stock Company with a Single Shareholder with a share capital of 5000€, whose head office is located at 6, rue d’Armaillé – 75017 PARIS (FRANCE), registered in the register of commerce and companies of Paris under the number 894 797 141.

    1. Scope and acceptance of the General Conditions of Sale

    Any order placed on the website https://www.abdouworld.com (hereinafter the "Site") requires consultation and prior acceptance of these Terms and Conditions of Sale before confirming the order.

    In addition, with each purchase of products on the Site, the Customer will be asked to confirm his acceptance of these Terms and Conditions of Sale in force on the date of placing the order. These general conditions can be viewed before and at the time when the Customer is asked to confirm his agreement.

    ABDOU WORLD S.A.S. products are exclusively intended for sale to end consumers, natural or legal persons, to the exclusion of all resellers or intermediaries acting on behalf of resellers.

    Consequently, the Customer affirms that he is acting as an end consumer and that he does not intend to resell the ABDOU WORLD S.A.S. products for commercial purposes.

    ABDOU WORLD S.A.S. can update its Terms and Conditions of Sale at any time. The Customer can take note at any time of the version of the Terms and Conditions of Sale in force by clicking on the link "TCS".

    Terms and Conditions of Sale in force at the time of the conclusion of the sales contract are those which are enforceable against the Customer.

    1. Terms of Order

    The Site allows the company ABDOU WORLD S.A.S. to order a selection of products, in particular the ABDOU brand (hereinafter the "Product (s)"), immediately online via the Internet for delivery to the countries designated at the site. Article 9.1.

    1. Availability of Products

    Product offers are valid if they are visible on the Site, within the limits of available stocks. Errors or modifications may exceptionally exist, in the case of simultaneous orders of the same Product by several customers.

    The products are described and presented with the greatest possible accuracy. While every effort is made to ensure that the color and pattern of the Products whose photos are displayed on the Site are faithful to the original Products, variations may occur, due to the technical limitations of color rendering on the computer equipment of the Customer.

    The Price of the order to be paid by the Customer is described in article 6.

    In the event of unavailability of a Product after placing the order, ABDOU WORLD S.A.S. will inform the Customer by email or telephone as soon as possible, proposing either to order another Product presented on the Site as a replacement, or to 'cancel the order.

    ABDOU WORLD S.A.S. does not incur any responsibility in the event of out of stock or unavailability of Products for orders not yet accepted by ABDOU WORLD S.A.S.

    ABDOU WORLD S.A.S. reserves the right to change the Products offered on the Site at any time and without notice. To ensure a better quality of service and availability of Products to all of the Site's customers, ABDOU WORLD S.A.S. reserves the right to limit the quantity of Products that can be purchased by a customer.

    1. Order procedure
    1. Product selection

    At any time, the Customer can add Products to their selection by clicking on "ADD TO CART" and choose to complete their purchases or continue browsing.

    The Customer can consult his selection by clicking on the basket in the menu where will appear:

    1. the photo (s) of the Product (s);
    2. his name (s),
    3. its characteristics,
    4. the quantity (s) chosen,
    5. its unit price (s)
    6. the subtotal of the selection,
    7. delivery costs;
    8. the total price of the order including delivery.

    The Customer may modify the quantities of products desired or remove the products directly from his selection.

    When the Customer has finished selecting the Products to buy, he can click on "Finalize the order".

    1. Identification

    If the Customer has a customer account, he must identify himself at this step by entering his e-mail address and password.

    If the Customer does not have an account, he will be invited to create one or he can continue his purchase (s) as a guest by entering his e-mail address.

    Any internet order requires the Customer to provide exact and complete information, in particular: title, surname, first name, telephone, email address, billing and delivery addresses.

    All information collected will remain strictly confidential. The Customer acknowledges and accepts that the use of his e-mail address and his personal password constitute Customer authentication. Any order placed with the identifiers will be deemed made by the account holder.

    Usernames and passwords are strictly personal; therefore, the Customer agrees never to communicate them to third parties. ABDOU WORLD S.A.S. can in no case be held responsible for any loss, theft or any fraudulent use of the customer account, where applicable the Customer must inform ABDOU WORLD S.A.S. immediately.

    The creation of an account allows the Customer to:

    1. monitor the status of deliveries of purchased products;
    2. consult the order history;
    3. add or modify delivery and billing addresses for future orders;

    The data recorded by the Site constitutes proof of all transactions between ABDOU WORLD S.A.S. and its customers. In the event of a dispute between ABDOU WORLD S.A.S. and one of its customers on a transaction carried out on the Site, the data recorded by ABDOU WORLD S.A.S. is considered as conclusive proof of the content of the transaction.

    The Customer may have his account deactivated or erased at any time by sending an e-mail to ABDOU WORLD SAS via the contact form, by clicking on the “Contact” link on the Site or directly by e-mail at the following address: contact@abdouworld.com .

    1. Confirmation of the order
    1. Confirmation of the delivery method

    The Customer continues his order by choosing the delivery address, the delivery method with the corresponding price, the billing address, and the method of payment.

    The Customer must complete the delivery information necessary for the correct shipment of the order: title, first name, last name, telephone, delivery address, country of dispatch.

    The Customer may use the delivery address as the billing address or enter a different one.

    1. Verification of the order and choice of payment method

    At the end of the ordering procedure described above and after having checked the summary order form and having read this Legal Terms of Sales by checking acceptance, the Customer can click on "Proceed to payment" to confirm his order.

    It is the customer's responsibility to verify the accuracy of their Product selection before confirming their order. 

    Consequently, ABDOU WORLD S.A.S. cannot be held responsible for errors or non-substantial inaccuracies in the photographs or graphic representations of the Products appearing on the Site.

    The validation of his order constitutes an electronic signature. This electronic signature serves as proof of the sales contract concluded between the Parties and makes the sums due under the Customer's order payable.

    The Customer will then choose the method of payment according to the terms described in Article 7 entitled "Payment".

    Once completed, the order is sent to ABDOU WORLD S.A.S. for processing.

    ABDOU WORLD S.A.S. reserves the right not to accept an order from a customer who has not fully or partially paid for a previous order, or with whom it is in dispute for a previous order, or if ABDOU WORLD S.A.S. reasonably considers that this customer has violated these Legal Terms or has engaged in fraudulent activity, or for any other legitimate reason.

    1. Order confirmation

    After acceptance of the order by ABDOU WORLD S.A.S. and validation of the payment made by the Customer, a summary of the order will then be sent by e-mail to the Customer.

    The acknowledgment of receipt will include the total amount of the order, information relating to the cost of delivery, the essential characteristics, quantity, and the price of the Products purchased.

    1. Price
    1. Price information

    The prices of the Products are indicated in Euros (€) all taxes included (T.T.C.) based on the prices in force on the day of the order.

    They do not include the delivery costs, invoiced in addition, and indicated before the validation of the order in the summary of the order and on the invoice. These costs will be paid by the Customer.

    They also do not include any costs of converting the Client's currency into Euro (€).

    It is possible that the payment of customs fees on the order will be requested upon arrival of the package if the Customer orders in an area outside the European Union.

    The prices consider the VAT applicable on the day of the order and any change in the applicable VAT rate will be automatically reflected in the price of the products in the online store.

    Payment of the full price must be made when ordering. At no time can the sums paid be considered as a deposit or down payment.

    If one or more taxes or contributions, in particular environmental ones, were to be created or modified, up or down, this change could be reflected in the selling price of the products.

    In the event of unavailability of certain Products ordered, only the price and transport costs relating to the available Products will be debited.

    1. Delivery costs

    The amount of delivery costs is calculated according to the Products chosen as well as the total value of the order in accordance with the price schedules of the company La Poste, delivery provider to ABDOU WORLD S.A.S., in accordance with Article 9.1.

    1. Price modification

    ABDOU WORLD S.A.S. reserves the right to modify its prices at any time but undertakes to apply the prices in force indicated at the time of the order, subject to the availability of products on that date.

    1. Payment


    Payment for the order is made online using the following means:

    Security measures and protocols are provided by Stripe, leader in secure online payment solutions.

    In the event of payment by credit card, ABDOU WORLD S.A.S. has no access to any data relating to the user's means of payment. Payment is made directly to the bank.

    The order or commitment to pay given by means of a payment card is irrevocable.

    The Customer guarantees to ABDOU WORLD S.A.S. that he has the necessary authorizations to make a payment by credit card.

    The order is sent only after verification of the method of payment and acceptance of the bank issuing the card. In case of refusal by the bank, the order will be automatically canceled.

    The debit of the credit card is only made at the time of dispatch of the order.

    1. Retention of title

    The ordered Products remain the property of ABDOU WORLD S.A.S. until full payment of the price by ABDOU WORLD S.A.S.

    The Customer takes responsibility for the risks (of loss, theft or damage) concerning the Products delivered from the time they are sent to the address indicated when ordering.

    1. Delivery
    1. Delivery and pick-up method and area

    The delivery method offered to the Customer uses the service of La Poste company.

    Products purchased on the site are delivered:

    The Products are shipped to the delivery address indicated by the Customer during the ordering process. To validate the order, the Customer is asked to enter a valid telephone number.

    The delivery date considers the time taken for preparation, handing over to the carrier and the latter's delivery.

    Delivery times are calculated in working days, i.e., excluding weekends and holidays. Any order placed on Friday afternoon, Saturday or Sunday will be processed by the following Monday.

    The delivery times referred to above may be longer than expected at certain times of the year (sales, end-of-year holidays, etc.) due to the large volume of packages to be processed.

    1. Transport costs

    The amount of delivery costs is calculated based on the Products chosen, the total order value of the delivery method chosen and the country of delivery according to the price list of La Poste company.

    1. Delivery problems

    Any error in the delivery address communicated by the Customer will be his full and entire responsibility.

    If the Customer has not come to pick up his parcel at the collection point, or the point of instance indicated in the transit advice note within the allotted time, the parcel is automatically returned to ABDOU WORLD S.A.S.

    The Customer should contact Customer Service to find out the procedure to follow for reshipping the order. The new shipping costs will be borne by the Customer.

    Any failure to deliver must be reported to ABDOU WORLD S.A.S. as soon as possible. Any complaint made more than fourteen (14) calendar days after the date of receipt of the order cannot be considered.

    It is the Customer's responsibility to check the condition of the Products, upon receipt.

    This verification is considered to have been carried out once the Customer, or a person authorized by him, has signed the delivery slip.

    If at the time of receipt of the order the Customer finds that it does not comply with the order form or that it has been damaged during transport, the latter may either refuse the package or in any case carry handwritten reservations on the delivery slip accompanied by his signature.

    The Customer must inform ABDOU WORLD S.A.S. of this on the same day of delivery or at the latest on the first working day :

    The terms of exchange are described in article 11.

    Exceeding a delivery time may not give rise to any damage and interest or withholding of any kind whatsoever, nor to the cancellation of orders in progress when this overrun result either from the Customer's fault, or from the fact, unforeseeable and insurmountable, a third party to the contract, or a case of Force Majeure defined in article 15.

    1. Right of withdrawal
    1. 10.1.Right and withdrawal period

    The Customer has a period of fourteen (14) days to exercise his legal right of withdrawal without having to justify his decision.

    The period of fourteen (14) days runs from the receipt of the Product by the customer or a third party designated by him when placing the order.

    In the case of an order for several Products delivered separately, the period starts from receipt of the last Product.

    ABDOU WORLD S.A.S. accepts the return of any product on the condition that it is intact and, in a condition, to be potentially resold (without restocking fees). The Customer will receive, at their choice, a credit on the site or a refund.

    After this period of fourteen (14) days, the Customer will no longer be able to exercise his right of withdrawal.

    1. Procedures for exercising the right of withdrawal

    The Customer may, before the expiry of the fourteen (14) days cancellation period mentioned in Article 10.1, by a clear statement expressing his desire to cancel:

    The surname, first name of the Customer who made the order as well as the order number and a valid e-mail address will be requested.

    The customer service will send a return label by e-mail to the Customer.

    The Customer must print it and use it to ship the return package.

    Return costs are the responsibility of the customer.

    1. Consequences

    After having notified his right, the Customer must return the products concerned within a maximum period of fourteen (14) days from this notification, accompanied with the return label. The conditions for returning products are detailed in Article 11 below.

    The right to cancel is inapplicable if the returned items do not meet the following conditions be in perfect condition for resale, in their original packaging, complete, fully labeled, new, unworn, unwashed, unstained, and undamaged.

    ABDOU WORLD S.A.S. will refund the Customer for the corresponding amount of the item and initial delivery charges paid at origin after verification of compliance.

    1. Terms of return, exchange, and refund
    1. Return and exchange

    If the Product is found to be defective or damaged without being caused by the Customer, or not corresponding to the order, the latter may request the exchange of the product and proceed with the return as described below.

    As part of the exercise of the right of withdrawal or an exchange request and to be eligible for a return, the Product must be unused and in the same condition as that received by the Customer, or in perfect condition for resale. It should also be in the original packaging.

    The Customer must return their products with the return slip sent by e-mail as well as the proof of purchase or the order receipt.

    For countries outside the EU, the Customer must specify to customs that this is a "return for non-compliance".

    The Customer must return the product to the address indicated in article 10.2, to the address: 

    ABDOU WORLD S.A.S. – 6, rue d’Armaillé – 75017 PARIS.

    The Products to be exchanged must be returned within 14 days of the date of the exchange or refund request. The product can only be exchanged after its return and quality control.

    If the Product is found to be defective or damaged without being caused by the Customer, or not corresponding to the order, the latter may request the exchange of the product and proceed with the return as described below.

    ABDOU WORLD will exchange the product upon receipt of the defective, damaged, or not corresponding to the order and after verification.

    Article exchange is only possible if the product is available.

    ABDOU WORLD S.A.S. will not charge transport costs in the event of an exchange.

    Taxes and customs fees that may have been paid upon importation, for shipments outside the EU, will not be refundable in the event of a return or exchange.

    1. Refund

    In the event of a refund request, the latter will intervene fourteen (14) days from the receipt of the Product (s) by ABDOU WORLD S.A.S. the refund, including the standard delivery costs of the initial order (excluding taxes and possible customs duties), will then be made according to the same method of payment used when ordering: by transfer to the bank account with which the Customer made their payment or to the Paypal account.

    An additional period may be applied by the Customer's bank when reimbursing.

    ABDOU WORLD S.A.S. will inform the Customer by email, after verification of the returned Product (s) of the good reception of the article(s).

    ABDOU WORLD S.A.S. will also inform the Customer of the approval or rejection of the refund depending on the quality of the Product.

    1. Legal guarantees

    All the products sold by ABDOU WORLD S.A.S. are subject to the legal guarantees on non-conformities of the product sold, under the conditions of articles L211-4 and those following of the French Consumer code, and on hidden defects of the product sold, under the conditions of articles 1641 and those following of the French Civil Code.

    1. Implementation of the guarantee of conformity

    ABDOU WORLD S.A.S. is required to deliver goods in accordance with the contract and is liable for any lack of conformity existing at the time of delivery.

    To be in conformity with the contract, the good must be suitable for the use usually expected of a similar good and, where applicable, present the qualities that a buyer can legitimately expect in view of the public declarations made by the Seller, or by its representative, in advertising or labeling.

    If the Product does not comply with the order, the Customer must file a complaint with ABDOU WORLD S.A.S., the contact details of which can be found at the top of these TCS, in accordance with Article 9.3.

    When acting as a legal guarantee of conformity, the Customer can choose between reimbursement or replacement of the goods, subject to the cost conditions provided for in article L217-9 of the French Consumer Code.

    The Customer is exempt from providing proof of the existence of the lack of conformity of the goods during the 24 months following delivery of the goods.

    In the event of unavailability of the Products on delivery, ABDOU WORLD S.A.S. may offer, under the conditions provided for in article 4, a Product equivalent in terms of quality and price.

    The action resulting from the lack of conformity lapses two years after delivery of the goods.

    1. 12.2.Implementation of the warranty against hidden defects

    ABDOU WORLD SAS is bound by the guarantee for the hidden defects of the item sold which make it unfit for the intended use, or which reduce this use so much that the Customer would not have acquired it or would only have given it a lower price if he had known them.

    The Customer may decide to implement the guarantee against hidden defects of the item sold within the meaning of article 1641 of the Civil Code. In this case, he can choose between the resolution of the sale, the exchange, or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

    ABDOU WORLD S.A.S. is not liable for apparent defects of which the buyer has been able to convince himself.

    The action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect.

    1. Protection and confidentiality of personal data

    The collection and processing of the Customer's personal data is carried out in accordance with the French Data Protection Act n ° 78-17 of January 6, 1978 as amended and the General Data Protection Regulation n ° 2016/679 of April 27, 2016.

    The data controller is ABDOU WORLD S.A.S.

    Personal data concerning the Customer is collected and processed by ABDOU WORLD S.A.S.:

    This processing of personal data is based on the execution of the sales contract binding ABDOU WORLD S.A.S. and the Customer.

    This processing of personal data is exclusively based on the Customer's consent, which can be withdrawn at any time.

    The Customer is informed that their data may also be subject to further processing for statistical purposes.

    All mandatory and necessary information to place an order, send newsletters or respond to a request under the "Contact" tab will be marked with a star on the Site.

    If the Customer refuses to communicate this data, ABDOU WORLD S.A.S. will not be able to process the intended purposes.

    All the Customer's data is kept in a format that allows it to be identified for the duration of the commercial relationship. Beyond that, they are archived during the common law limitation period for evidentiary purposes only.

    The data collected is intended for ABDOU WORLD S.A.S. and, where applicable, its service providers in charge of order management and customer relations.

    Personal information is reserved exclusively for internal use and will not be transferred or sold to third parties without the customer's express acceptance.

    Regarding information concerning him, under the conditions provided for by the law and the regulations in force, the Customer has a right of access, modification, rectification, the right to lodge a complaint with an authority. control, the right to limit processing, the right to erasure of data as well as the right to portability of data concerning him in his customer account, without prejudice to the right he also must oppose under the conditions for the use of his personal data.

    The Customer can exercise his rights:

    1. Intellectual Property

    All intellectual property rights attached to the Site (and without limitation, photographs, illustrations, videos, logos, brands, designs, and models, etc.) are the exclusive property of ABDOU WORLD S.A.S.

    Any use or reproduction in any way whatsoever, on any medium whatsoever, of all or part of the content of the site is subject to the prior written and express authorization of ABDOU WORLD S.A.S., under penalty of prosecution.

    Only the consultation of the content published on the Site is authorized for exclusively private, personal, and non-commercial use.

    The domains to which the hypertext links on the Site lead do not engage the responsibility of ABDOU WORLD S.A.S. which has no control over these links.

    It is possible for a third party to create a link to a page of the Site without the express permission of ABDOU WORLD S.AS.

    1. Force majeure

    ABDOU WORLD S.A.S. will not be responsible for the delay in the performance or the total or partial non-performance of its obligations if this event is due to a case of force majeure or fortuitous event.

    Cases of force majeure or fortuitous are considered as any irresistible facts or circumstances, external to the parties, unforeseeable, inevitable, independent of the will of the parties and which cannot be prevented by the latter, despite all the efforts reasonably possible.

    The cases of force majeure or fortuitous event usually retained by the case law of French courts are cases of total or partial strike of means of transport or supplies, postal services, shutdown of telecommunications networks, fires, storms, earthquakes, flood etc.

    ABDOU WORLD S.A.S. will notify the Customer of an event constituting force majeure within ten (10) days of its occurrence.

    The Parties will come together to examine the impact of the event and agree on the conditions for processing the order for the duration of the force majeure event.

    If the case of force majeure lasts longer than one month (1) month, the order will be canceled by ABDOU WORLD S.A.S.

    1. Partial invalidity

    If one of the provisions of these Legal Terms of Sale is held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other provisions will keep all their strength and reach.

    1. Non-waiver

    The fact that ABDOU WORLD S.A.S. does not invoke a breach by the other Party of any of the obligations referred to in these Terms and Conditions cannot be interpreted for the future as a waiver of the obligation in question.

    1. Applicable law – Disputes

    The language of these Terms and Conditions of Sale is English . If they are translated into one or more foreign languages, only the English text will prevail in the event of a dispute.

    These Terms and Conditions of Sale are governed and interpreted in accordance with French law.

    However, for residents of the European Union, and in accordance with EC Regulation n ° 593/2008 of June 17, 2008, these General Conditions of Sale do not prevent ABDOU WORLD S.A.S. from complying with a provision more favorable to the customer and which cannot be waived by agreement, under the law where the Customer has his habitual residence.

    In the event of a dispute or complaint, the Customer will first contact ABDOU WORLD S.A.S. to obtain an amicable solution and in the event of failure, he may resort to a consumer mediator.

    Notwithstanding the above, in the event of a dispute and when the Customer resides in the European Union, in accordance with Regulation No. 1215/2012 of December 12, 2012:

    If the Client resides outside the European Union, the French courts will be competent.
